Here is all of the ZapSpot legal stuff. Our lawyers wrote it so that you know
what the rules are when you use ZapSpot products and/or services
("ZapSpot"). These rules apply even if ZapSpot is brought to you by
someone else. You will know if ZapSpot is brought to you by someone else because
you will see our name and their name like "ZapSpot brought to you by The
Most Famous Company in the Whole World." By using ZapSpot (however it gets
to you), you agree to be bound by the following terms and conditions:
ZapSpot is a U.S. company, and we're currently focused on making the U.S.
a little less productive with our fun little distractions. Unfortunately,
that means that we are too busy coming up with fun games for you to play and
worrying about complying with U.S. laws to research non-U.S. laws. So, if
you are a non-U.S. resident, figuring out and abiding by your country's
legal stuff all falls on you. If you are not a U.S. resident, you can use
ZapSpot products and services, but you are responsible for making sure that
your actions and your use of ZapSpot products and services comply with your
local laws, and any other laws that might apply.
ZapSpot is full of fun Content. "Content" is the buzz-word for
all of the text, graphics, pictures, and data that we use in our products
and services. Someone owns all of that Content, but it is not you. The
Content is either owned by ZapSpot itself, or ZapSpot is licensing that
Content from someone else ("Licensors"). If ZapSpot is licensing
the Content, then the Licensor owns the Content. When we say ZapSpot or its
Licensors "owns" the Content, we mean the whole kit and caboodle
(everything). "Own" means all right, title, and interest,
including the copyright, trademark, patent and any other form of
intellectual property right recognized on earth or in space. And just so it
is clear, ZapSpot owns the copyright in ZapSpot products and services,
including our web site. Anything you post or otherwise attach to ZapSpot
products and services becomes ZapSpot's property. That's right, we will own
it.
Here is what we will let you do with the Content. You can send unmodified
(that means no changes whatsoever) copies of the Content to anyone you want.
You can send it to your friends and family, or even people you wish were
your friends or your family. You can even put it on your web site.
Basically, we want the whole world to play ZapSpot games. But, you cannot
modify the Content or state or imply (that means even insinuate) that the
Content is yours. We will not let you charge for it, so don't even THINK
about it. In fact, you are not allowed to make even the slightest bit of
commercial use of the Content.
ZapSpot owns all of its trademarks, service marks and logos which we love
to splash on ZapSpot products and services. Actually, we just love to see
and hear our name. ZapSpot.
ZapSpot. ZapSpot. See how nice it sounds!
Furthermore, we do not own the trademarks, service marks and logos of other
companies. They do. So, no matter how many of your own products or services
you think you would sell if you used our trademarks, service marks or logos,
you have no right to use any of them. Same goes for those other companies.
ZapSpot is busy coming up with new ideas for games. So we cannot be in
court all the time. So, enjoy the games, but don't take any of the Content
too seriously because we are not guaranteeing it is anything but fun and if
you are a really dull person (like one of our attorneys) you may not think
it is even fun. So, we are not guaranteeing that either. (Read: NO
LIABILITY). While we are on the subject of what we're not liable for, here
is some more info: ZapSpot and its Licensors are not liable for any direct,
indirect, incidental, consequential or punitive damages arising from your
use of ZapSpot products and services. ZapSpot products and services are
PROVIDED "AS IS." ZAPSPOT MAKES NO WARRANTIES, OF ANY KIND, EITHER
EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY OR
FITNESS FOR A PARTICULAR PURPOSE OR NON-INFRINGEMENT. (Our lawyers told us
some law requires this to be in all capital letters so you get it.) This
means that we are sorry, but we will not be responsible for any bad or even
unfortunate thing that happens when you use or try to use or even think
about using our products or services. And if you do sue us (which we really,
really hope you don't), you are going to have to sue us in New York County
and be bound by New York law. This means that even if you live in California
or some other state which is not New York State, you will have to show up
yourself in New York City or hire some New York City attorney to help you
sue us.
ZapSpot reserves the right to stop providing ZapSpot products and services
at any time without notice and without any liability whatsoever. ZapSpot
would like to stay in business forever and be the most successful company
since The Most Famous Company in the Whole World (see above). However, if we
decide for whatever reason to stop providing ZapSpot products and services,
we will not be liable to any person in regard to ZapSpot products and
services. That means that even if you are our favorite ZapSpot customer (you
are) and you registered for regular games for the rest of your and your
grandchildren's lives (we hope you do), we can stop sending you games
without any liability on our part. That means that you cannot sue us to get
us to resume sending you games or even to get money damages for the pain,
suffering or any other harm you experience from the absence of ZapSpot
products and services in your life (or your grandchildren's lives). You may
have guessed that this means that if we fail to deliver or deliver late
(even very late) any ZapSpot product or service, we are not liable.
ZapSpot contains links to many sites on the Web. But, we are us and they
are them. We are responsible for us and they are responsible for them. You
visit them at your own risk.
Despite our rather irreverent sense of humor (we can't help ourselves), we
care about your privacy. So, although we might provide others with
information about the users of our site, we will not provide them with any
information that identifies you directly. This means no one except ZapSpot
will be able to identify you individually, unless we have your permission.

in being bored to tears by our lawyers (they try to be cool, but let's just

We are pretty sure that companies which you learn about via ZapSpot are
going to try to get you to buy their products and services. If you do,
that's between you and them. (This is another variation of we are us and
they are them. We are responsible for us and they are responsible for them.)
If there is a problem (and we hope there isn't), contact the company (them)
directly. ZapSpot is not liable, in any way, for any of the products or
services that a company (them) might offer via ZapSpot products and services
(us).
ZapSpot is not liable for the content of any chat rooms or bulletin boards
on ZapSpot products and services or those of any other company reached via
ZapSpot. This includes not being liable for errors (blatant or hidden, huge
or slight), libel (that's the stuff one reads), slander (that's the false
stuff people say), obscenity (you should know it when you see it), or
anything else that might violate any law or offend folks.
ZapSpot reserves the right to revise the terms and conditions for use of
