When you use ZapSpot products and/or services, we collect certain information in order to improve and enhance the products and services that you receive from us. Depending on the options that you select, that information may allow us to customize and personalize your experience with our service.

ZapSpot is committed to protecting your privacy. Because we know that privacy is a concern of yours, we are providing this notice to you. It explains what information we collect, why we collect it, and the manner in which this information is used.

If you are under 18 years old and want to become a registered user of ZapSpot Products and Services, we would like, but do not require, your parent's permission to register. If you are under 12 years old, we require it.

WHAT INFORMATION WE COLLECT AND WHY

Some of the Requested Information we receive from you is required in order for us to actually provide you with our own products and services. When we say "calculated" information ("Calculated Information"), we mean the information that we capture and send back to our servers such as which advertisements have been viewed or clicked-on, which games are most popular, and whether you are using a ZapSpot product or service brought to you directly from ZapSpot or via a third party. Calculated Information is generated from the various actions that you take within our service and is sent back to us when you are online. If you register for our service by providing your e-mail address, we will associate your Requested and Calculated Information with your e-mail and we may use this information to customize and improve the games, services, and promotions that you receive from us.

When we refer to "roaming" information ("Roaming Information"), we mean the information that allows you to use ZapSpot from any machine connected to the Internet, such as your high-scores, sound, video, and computer settings, or the ZapSpot options that you select for the service or a particular game.

PROTECTING YOUR PRIVACY

ZapSpot will not sell, trade, or rent to others any Requested, Calculated, or Roaming Information that identifies you as an individual.

In order for us to provide you with the best service possible, we may at times be required to submit certain Requested Information to the independent contractors or independent, third party agents to whom we outsource certain parts of our business processes, or who perform certain services for us. We request contractual obligations from these independent contractors and agents to safeguard the confidentiality of all information they process for us. While we seek to protect the confidentiality of the information we provide to those independent companies and individuals, we cannot guarantee what uses those parties will make of that information nor do we assume any liability whatsoever for them.

ZapSpot reserves the right to release Requested, Collected and Roaming Information when we believe that such release is necessary to comply with any applicable law or to protect the rights, property, interests, or safety of ZapSpot, our customers or others.

ZapSpot may release Requested, Calculated, and Roaming Information when we, in good faith, believe that such release is reasonably necessary to comply with the law or protect the rights, property or safety of ZapSpot, our customers, or others.

WHAT WE USE THE INFORMATION FOR

ZapSpot is committed to providing you with the best service possible, which means delivering the best games to you. In order to do that, we will use Calculated Information about game-play behavior for every user of ZapSpot. This Calculated Information may include, but is not limited to, usage information on when a game is opened and how much time is spent within a game. Calculated information is normally anonymous, i.e. it does not identify you as an individual. However, if you subscribe to our e-mail gave update, we will associate this information with your e-mail in order to deliver a personalized game to you every couple of weeks. If you do not wish to receive our personalized e-mail update, you can simply unsubscribe from our mailing list.

Because ZapSpot allows users to experience the ZapSpot service from any machine connected to the internet, we track and store information such as high-scores, game settings, and sound, video and computer settings to ensure that users have a similar ZapSpot experience regardless of their location. Roaming information will be used by ZapSpot to allow users to move to a different machine or to recreate their ZapSpot experience on one of their own machines.

ZapSpot may provide certain Requested, Calculated, or Roaming information to third parties such as marketers and advertisers, who make use of general customer data. We assure you that such disclosure does not include any information which could personally identify you or be directly associated with you as an individual. For example, we may provide an advertiser with the ability to target customers that are playing a certain game or live in certain zip codes or countries.

In the course of using ZapSpot products and services, ZapSpot will also be tracking usage information such as which games you tend to play most often and which advertisements you've clicked on. In general, we will use this Calculated Information to help target special offers and advertisements to you. If you do not want us to use usage information to present personalized advertisements and promotions, you can simply opt-out of the personalization.
